New York State is yet again trying to make massive cuts and changes to home and community based services for the disabled. Personal Care Services (PCS) and Consumer Directed Personal Assistance (CDPA) are both forms of home attendant programs that allow disabled New Yorkers to live in the community, and are currently under threat.

The most recent Health Budget Law (S. 7506-B; A. 9506-B) that passed through the State Legislature’s Health Committees modified the eligibility criteria for home care. Once in state law, the DOH has the authority to interpret and propose regulations on HOW that law is implemented. In July 2020, they released regulations to amend sections 505.14 and 505.28 of Title 18 NYCRR, and is giving the community a 60-day commentary period to provide feedback before they move forward with these changes. In summary, they want to make eligibility criteria MUCH higher so people will be denied, and they want to give the state much more room to judge us ‘more fit’ for an institution. Half of these concerning changes are what passed through state health committees, and half are the DOH. Twitter Tips:
